CREDIT CARD PAYMENT TERMS

We accept payments online using Visa and MasterCard credit/debit card in AED

Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE. United Arab of Emirates is our country of domicile. souq9.com will NOT deal or provide any services or products to any of OFAC sanctions countries in accordance with the law of UAE Refunds will be done only through the Original Mode of Payment.

 

ORDERS & CANCELLATIONS

We process all our orders in same working day or the next working day. For any reason if we are not able to process the order within 2 working days, the system automatically cancels the order and fresh order needs to be placed again.

All orders placed through our website will be subject to our acceptance of the order. We reserve the right to decline any order for any reason. Any orders placed through the website will be considered as legitimate orders. If the payment method is “Credit Card” the order will be processed once the bank confirms the payment.

Although we endeavor to keep our website information and pricing up to date and error free, product description or pricing errors may occur. If such an error is discovered after you have submitted an order to us, we will contact you before processing your order and give you the option to either cancel your order or re-confirm it based on the correct information. If we are unable to contact you, we will treat your order as cancelled.

REQUEST TO CANCEL THE ORDER

If you would like to cancel an order the same can be done within 12 hours of the purchase made. Calling the office and confirming the same with the support team can do the cancelation. If the order is under processing then it can still be canceled but it will be up to the management’s discretion, and a charge of  20% of the product value will be levied for processing fees. If any orders are cancelled and have been paid for using a credit card, then the refund process may take up to 25 days (subject to the bank’s policy).

If the order has already been dispatched then it will not be possible to cancel it. In some cases special exceptions may be made, allowing the order to be canceled but this will again be up to the management’s discretion and a charge of 30% of the product value will be levied for processing fees.

Any products that are authorized for return must be in perfect condition with sealed packaging and all accessories intact. Final approval to collect items will only be given once an inspection of the items has taken place.

Delivery charges are non refundable.

WARRANTY AND RETURNS

All the products and service we offer through souq9.com carry’s manufacturers warranty as per the manufacturers warranty terms and conditions. We source all our products from genuine sources and distribution channels to assure you the best quality and authenticity. Following are the standard warranty terms and conditions.

All Gadgets and devices other than accessories and services carry one-year manufacturers repair warranty.

The warranty of the product will be void if the product is physically damaged; warranty seal is tampered, dropped in water, met with an accident or used in any way that is not recommended by the product manufacturer.

All the products supplied by souq9.com -except services- carry a serial number, which is recorded in the users account during the delivery of the product. If the serial number of the product is not matching with the records, the warranty is not claimable.

All warranty period starts from the date of purchase.

Any warranty request has to be pre-approved by emailing the complaint to info@souq9.com or by calling +971 55 5239 620 and by obtaining a warranty claim number. This number will be referred for all follow-ups and claims.

TRADEMARKS & COPYRIGHTS

All of the names, titles, logos, and designs on souq9.com identifying our products and brands, including any derivative and related names, titles, logos and designs, are trade-marks and the sole and exclusive property of Al Taiyeb Trading FZC. All other names, titles, logos and designs appearing on souq9.com are the property of their respective owners. Any use of any trademarks appearing on souq9.com without the express written consent of the owner of the trademark is strictly prohibited.

souq9.com contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, photographs, graphics, images, illustrations, audio, video and software (collectively, the “Content”) and the entire contents of souq9.com also are protected by copyright as a collective work and/or compilation under the UAE copyright laws, international conventions and other copyright laws. souq9.com and/or its affiliates own the copyright in the Content original to souq9.com and in its selection, coordination, arrangement and enhancement of the Content.

USER CONDUCT

By visiting and using souq9.com, you agree to comply with all applicable laws and these Terms and Conditions when using such site. You acknowledge that souq9.com may investigate any violations of law and may cooperate with law enforcement authorities in prosecuting users in this regard. Additionally, you agree not to: post, spread, connect, link or distribute any materials, information that may constitute a criminal or unethical offence to civil liability or use or refer souq9.com in a manner that is against the law of the country or against any Government, rulers, or any individual is strictly prohibited.

MINORS

 In cases where you have authorized a minor to use souq9.com you realize that you are fully responsible for: (i) the online conduct of such minor; (ii) controlling the minor’s access to and use of such site or service; and (iii) the consequences of any misuse by the minor. You acknowledge that some of the areas of souq9.com may contain material that is inappropriate for minors.

PROCESSING ORDERS & PAYMENTS

Once an order has been placed through the website, regardless of the payment method chosen, it will be classed as a legitimate order. Different customers may be subject to different payment terms.

The “Cash on Delivery” payment option will not be allowed for any orders that exceed AED 3,000. Allowing “Cash on Delivery” for orders with a value higher than AED 3,000 is up to the company’s discretion.

SHIPPING & DELIVERY

Delivery at this time will only be available to limited countries including UAE, India, Saudi Arabia, Oman, Qatar and Bahrain. souq9.com will deliver any ordered items within 2 business days within UAE and 7 days outside UAE. We endeavor to deliver on time but in the event of a delay souq9.com will not be held responsible. If orders are not delivered within 14 days of the stipulated time then the customer has the right to cancel the order at no cost to them. All Items are subject to stock availability.

Customers will be asked to sign for the goods upon delivery. If wrong shipping information has been given at the time of order then any additional delivery charges and processing fees will be borne by the customer. Once delivered and signed for, no claim of damaged goods will be accepted.

Any additional taxes or customs duties of any kind if not previously stated, are not included and must be paid by the customer.

The delivery and the billing addresses can be different, however at the time of delivery a valid form of photo identification needs to be presented.

In addition, if either “Credit card on delivery”, or “Credit card online” are selected as the payment methods then the details on the photo ID should exactly match that of the credit card used to make the purchase.

Delivery to public/communal places will not be allowed.

PROVISION OF LEGAL DOCUMENTS

In an effort to increase the safety for our shoppers, and in line with our banks security requirements, we may from time to time ask for a copy of a valid ID and the front side of your credit card. This may be at the time of delivery, or at the time of order processing. We accept the following as a form of valid ID (National Identity Card, Driver’s license, Passport copy). Failure to provide such documents upon request may lead to cancellation of the order and payment of the related charges.

All information is collected lawfully and in accordance with prevailing Data Protection Laws.

PRICING

If a product has been added to the shopping cart and a price update takes place on the site before the user has checked out, then the price of the product in the shopping cart will also be updated automatically. Therefore all customers must check the final checkout price before placing the order.

If a product has been added to the shopping cart, but before the final checkout stage, the product is removed from the website, the product will be removed from the final cart. Therefore all customers must check the final list of products before placing the order.

Whilst we endeavor to ensure the prices on our website are as accurate as possible, we reserve the right to change a price in exceptional circumstances. If a price is corrected due to exceptional circumstances, customers will be informed of the change before payment is processed and offered the opportunity to cancel the order.

Prices on orders for out-of-stock or pre-release items are valid for one week after the order is placed. If the price changes when the stock becomes available customers will be informed of the change before payment is processed and offered the opportunity to cancel the order.

INDEMNIFICATION

You agree to defend, indemnify and hold harmless each of souq9.com, its affiliates and licensors and each of their respective officers, directors, employees and agents, including all third parties mentioned on souq9.com, from and against any and all claims, actions or demands, including without limitation reasonable legal and accounting fees, resulting from or related to: (a) your breach of any of these Terms and Conditions; (b) your access to or use souq9.com or Content; or (c) your use or reliance on, or publication, communication or distribution of anything on or from souq9.com. You shall use your best efforts to cooperate with us in the defense of any claim. souq9.com reserves the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

Limitation of Liability

You expressly understand and agree that in no event shall souq9.com, including without limitation its subsidiaries, affiliates and licensors, be liable for any damages whatsoever, including any direct, indirect, incidental, consequential, special or exemplary damages, and any damages for loss of profits, savings, goodwill or other intangible losses, regardless of whether souq9.com had been advised of or could have foreseen the possibility of such damages, arising out of or in connection with: (a) the use, inability to use or performance of any of the services of souq9.com, or (b) any unauthorized access to or modification to any of your content or transmissions, or (c) any other matter relating to souq9.com or any of the services.

GENERAL

This agreement is personal to you, and you may not assign your rights or obligations to anyone.
